These Terms of Use govern your access to Perchance AI, available at https://perchanceai.cc, and the limited services that remain available through the website. The service is operated by Ethan Sunray LLC (“we,” “us,” or “our”). By accessing or using the service, you agree to these Terms and our Privacy Policy.

Current Service Status

The service is no longer accepting new registrations and no longer offers new purchases, subscriptions, renewals, or upgrades. Existing users may continue to sign in, recover their accounts, use unexpired credits already associated with their accounts to generate images, and review the account and billing information that remains available.

The service is maintained only for limited support and necessary bug fixes. Features may be changed, restricted, suspended, or discontinued where reasonably necessary for security, legal compliance, technical operation, or the wind-down of the service.

Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You must provide accurate information when using account recovery and notify us promptly if you suspect unauthorized access.

Accounts and credits may not be sold, transferred, or shared. Credits are subject to their existing expiration dates, have no cash value, and may only be used for the image-generation functions currently made available to the applicable account.

AI Image Generation

The service uses third-party artificial intelligence systems to process text prompts and produce images. AI output may be inaccurate, unexpected, incomplete, similar to content created for others, or unsuitable for a particular purpose. We do not guarantee that any output is unique, error-free, available, or eligible for copyright or other intellectual property protection.

You are responsible for reviewing generated images before using them and for determining whether your prompts and use of the output comply with applicable law, these Terms, and any rights of third parties. The service does not provide legal advice or clearance of any generated content.

Content Rules

You must not use the service to create, request, store, or facilitate content that:

• is illegal, fraudulent, threatening, abusive, exploitative, or harassing;
• sexualizes minors or depicts child sexual abuse or exploitation;
• promotes terrorism, violent extremism, or instructions for serious wrongdoing;
• infringes copyright, trademark, privacy, publicity, or other third-party rights;
• impersonates a person or uses a person’s identity, likeness, biometric traits, or private information without any consent or other lawful basis that may be required;
• contains malware, attempts to bypass safeguards, or interferes with the service; or
• otherwise violates applicable law or payment-network requirements.

You represent that you have all rights, permissions, and consents needed for the prompts and other material you submit and for your intended use of generated images. In particular, you must not create deceptive or harmful representations of real people or imply their endorsement without authorization.

Content Moderation and Enforcement

We use automated safeguards to review prompts and generated images for prohibited or unsafe content. A request may be blocked, an output may be withheld, and access may be restricted when content triggers those safeguards or when the moderation service is unavailable. No moderation system is perfect, and the presence or absence of a moderation decision does not approve content or transfer responsibility away from you.

We may investigate suspected misuse and suspend or terminate access when reasonably necessary to enforce these Terms, protect users or third parties, maintain service integrity, or comply with law. We may also preserve or disclose relevant information where required by law or reasonably necessary to address abuse, security incidents, or legal claims.

Intellectual Property

The website, software, branding, interfaces, and other materials we provide are owned by us or our licensors and are protected by applicable intellectual property laws. Subject to these Terms, we grant existing users a limited, revocable, non-exclusive, non-transferable right to use the remaining service functions for lawful purposes.

As between you and us, we do not claim ownership of the original text prompts you submit or any rights you may have in generated images. This statement does not guarantee that rights arise in an AI-generated image or that the image does not affect third-party rights. You grant us and our service providers the limited rights necessary to process your prompts, provide and secure the service, moderate content, and comply with legal obligations.

Availability and Disclaimers

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy. We do not promise uninterrupted access, preservation of any content, compatibility with other services, or correction of every defect.

Limitation of Liability

To the maximum extent permitted by applicable law, we and our suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, business, goodwill, or opportunity arising from the service. Our aggregate liability for claims relating to the service will not exceed the amount you paid to us for the service during the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Governing Law and Mandatory Rights

These Terms are governed by the laws of the United States and the applicable laws of the state in which the Company is organized, without regard to conflict-of-law principles. You remain entitled to any mandatory consumer protections that apply in your place of residence. You must not access or use the service in violation of sanctions, export-control laws, or restrictions applicable to you.

Changes to These Terms

We may update these Terms to reflect changes to the limited service, legal requirements, or security practices. Updated Terms become effective when posted unless applicable law requires otherwise. If you do not agree to an update, you must stop using the service.
